Florida DUI Lawyer Confronts Irregularities in South Florida DUI Breath Test Results

Carlos A. Canet, Florida DUI defense attorney, is in the process of a thorough investigation into the breath testing equipment and procedures used in South Florida counties. The Law Office of Carlos A. Canet, P.A., emphasizes the defense of DUI cases in Miami-Dade County, Fort Lauderdale and Broward County and Palm Beach County.

Mr. Canet is currently involved in a major project intended to suppress the use of Intoxilzyer results in Florida DUI cases. The Intoxilyzer 8000 challenge project has required the use of expert witnesses in the field of forensic toxicology and statistics. Forensic toxicology is required due to the fact that several of the raised issues directly correlate to the accuracy and reliability of breath test results.

It has been brought to attention that FDLE, the agency responsible for maintenance of the Intoxilyzer machines, have consistently failed to do so properly, potentially leading to Florida DUI arrests based on false positives registered by the breath testing machines. One issue is the use of tap water, rather than the prescribed purified water, in the machines. Tap water registers false positives for alcohol in the Intoxilyzer machines, and has been used in them for years. Carlos A. Canet is working diligently on the case in Broward County court.
