A man charged with DUI manslaughter in Miami has been denied bail and will remain in jail until his trial. Gabriel Delrisco crashed into the back of a Ford minivan on Jan. 25, killing three children. Prosecutors said Delrisco should be kept in jail because he could be a threat to public safety.

In Florida it is illegal to drive with a Blood Alcohol Content (BAC) of 0.08 or greater. According to Gabriel Delrisco's arrest report, a sample of blood taken soon after the crash showed a BAC of 0.234, nearly three times the legal limit. A second sample was taken at Ryder Trauma Center that showed a level of 0.152, about twice the legal limit. The Florida Highway Patrol says it could be two months before they finish their investigation of the deadly crash.

Gabriel Delrisco is a habitual traffic offender who has been ticketed 26 times since 2001, half for moving violations. Delrisco was arrested for driving under the influence in 2001 where he was convicted for DUI in Miami-Dade County. Delrisco was arrested for reckless driving in June 2004. Other moving violations include speeding, failure to stop at a traffic light, driving the wrong way on a one-way street, and crossing a median.
The community is shocked that Delrisco was even in possession of a driver's license considering his record of moving violations. Since the crash, the community has rallied around the Serrano family. Radio station Power 96 raised more than $50,000 to help the family with burial costs, in one morning alone. Miami-Dade fire fighters also collected donations at the crash site.
