New Challenges to Breath Test Results

This week the Law Office of Carlos A. Canet, P.A., a law firm specializing in defending those arrested for DUI in South Florida, filed pleadings intended to bring a massive challenge to all breath test results taken from Broward County DUI arrests.

The motion, entitled, "Motion To Exclude Breath Test Results for Lack of Substantial Compliance," outlined in detail the numerous problems kept hidden by DUI law enforcement authorities in Fort Lauderdale and throughout DUI arrests made in Broward County. DUI Lawyer Carlos A. Canet with offices in Fort Lauderdale, through investigation has documented problems with the Intoxilyzer 8000 that have prejudiced his clients arrested for DUI in Miami-Dade, Broward and Palm Beach counties.

Intoxilyzer Source Code

It has been recently reported that the Second District Court of Appeal will affirm the order of a County Court judge in Sarasota, Florida, directing CMI to disclose the source code for the Intoxlizer 8000.

I have posted on occasion and released to the press ongoing developments with this issue. As will be recalled, CMI, Inc., is the manufacturer of the Intoxilyzer in all its manifestations. For years DUI lawyers and DUI defense attorneys, including myself as a Miami-Dade, Broward County DUI defense lawyer, and Palm Beach DUI defense attorney have sought to have the company disclose the source code for the Intoxlizyer.

Selecting A DUI Defense Lawyer

Once someone has been arrested for DUI, the next most important decision to make is whether to hire a lawyer. Several components factor into this decision. However, once the decision has been made, what are the criteria to ensure the best choice possible? The first is to trust your instinct. Your inner voice will, in most cases, make you aware that you are moving in the right direction. Many people are completely intimidated by the process of selecting a lawyer because they understand that although they exercise control over whom they will choose; the choice itself is made completely upon faith. That is why I say trust your instinct. In other words, your level of comfort with the person selected.

The choice is important because DUI carries such severe penalties and hiring a lawyer can be very expensive. The wrong choice can have disastrous consequences. I understand that so far I may be stating the obvious but when I see and hear about the poor decisions some folks have made in this process I cannot be too concerned with understatment. DUI defense in Florida is very serious business. This is true regardless of whether the DUI was in Miami-Dade County, Fort Lauderdale, Broward County or Palm Beach County.
